From the 'what-were-they-thinking' department. Almost a year after the WLS decision was made by the Board and three months before it was going to be implemented by Verisign, the plaintiffs in the WLS litigation -- Dotster, eNom and GoDaddy -- filed a motion for a temporary restraining order against ICANN on July 16th. The lawyers reading this won't be surprised that the motion was denied at a hearing on July 18th. (For the non-lawyers, you can only get temporary, emergency relief when you have, well, an emergency. After waiting a year to file the complaint and with months before any real harm occurs, it's sort of hard to claim you have an emergency.) The Court also denied the plaintiffs' claim for expedited discovery. I should have copies of all the pleadings by tomorrow.
